标 题: 关于EB1A 485 pending 180天内换工作的问题

刚刚知道自己的EAD批了,新工作那边也急着让我入职。突然意识到一个叫做AC21
portability的问题。我是5月16号寄出的485,如果我10月16号入职新工作的话,那么
485才pending了5个月,还不到180天。我在本版查到的信息都是说EB1A不受这个180天
的限制,但是其他的英文网站好像都说需要等180天。不知道版上有没有成功在180天内
换过工作的朋友来现身说法一下。
我自己也查了一些律师的说法,其中一个律师说,只要I-140不被revoke,就算180天内
换工作也不会导致485被拒:
Using AC21 if leaving your employer before the 180 days:
The fact that you have left your previous employer prior to your I-485
pending for 180 days is not the basis for denial of your portability case
since adjustment of status is based on prospective employment, rather than
an existing one.
However your I-485 case will be denied if any of the following happens:
Your I-140 is withdrawn by your employer before your I-485 reaches 180 days;
or
Your I-140 is denied by the USCIS at any time; or
Your approved I-140 is revoked at any time, except when it is based on a
withdrawal request from your employer (not fraud related, for example)
submitted after your I-485 has been pending for 180 days; or
You fail to prove that a bona fide employment relationship existed at the
time of filing.
So leaving too early obviously makes it more difficult to establish your
case, especially if your employer is no longer willing to cooperate.
我也读了一下INA section 204(j)。这是关于supplement form J: Confirmation of
Bona Fide Job Offer or Request for Job Portability。这个文件就是关于485
pending 180天以上换工作的说明。里面明确说明了,EB1A和NIW不需要file这个J表。
那我是不是可以理解为,我的EB1A压根不受180天的限制?
还有就是问问大家,如果换了工作,需不需要通知USCIS?该如何通知?
